These Terms of Service ("Terms") are a binding agreement between you and Green House LLC, doing business as Wyphi ("Wyphi," "we," "us," or "our"), governing your access to and use of the Wyphi website, web application, meditation sessions, personalization features, subscriptions, and related services (collectively, the "Service").
By creating an account, using the Service, starting a trial, or purchasing a subscription, you agree to these Terms.
You must be at least 18 years old and legally capable of entering into a binding agreement to use Wyphi. Wyphi is not intended for children or minors. If we learn that an account belongs to a person under 18, we may suspend or close the account.
Wyphi provides customizable meditation and wellness experiences that may incorporate guided meditation, breathing practices, soundscapes, binaural audio, tonal frequencies, frequency-based sound design, and related features.
Wyphi is not medical care, mental-health treatment, psychotherapy, emergency support, diagnosis, or a medical device. Wyphi does not diagnose, treat, cure, or prevent disease or medical or mental-health conditions.

You are responsible for maintaining the confidentiality of your account credentials and for activity under your account.
You agree to provide accurate account information and to notify support@wyphi.com if you suspect unauthorized access.
You may not share or use an account in a way that defeats subscription, security, or access controls.
Wyphi allows you to provide information such as how you want to feel, an optional free-text note, session preferences, and post-session feedback to help create and maintain your meditation experience.
You retain ownership of information you submit.
You authorize Wyphi to process that information as reasonably necessary to create the session you requested, provide session history or replay features, operate and secure the Service, fulfill privacy requests, and provide support as described in our Privacy Policy and Consumer Health Data Privacy Policy.
Raw free-text intention text is processed transiently and is not retained in your saved Wyphi session record. Wyphi may retain derived session information necessary to provide and maintain the personalized session.

Where offered, eligible users may receive a 7-day free trial.
The checkout screen presented to you controls the specific offer. Before you authorize payment, Wyphi will disclose the trial period, recurring price, billing frequency, automatic-renewal terms, and method of cancellation.
Unless you cancel before the applicable trial or billing period ends, your subscription automatically renews and your payment method will be charged the then-current recurring price plus applicable taxes.
You may cancel through the online subscription controls available in your Wyphi account.
Cancellation stops future recurring renewal charges. Unless otherwise disclosed or required by law, access associated with an already-paid billing period continues through the end of that period.
Deleting your Wyphi account also cancels an active Wyphi subscription as part of the account-deletion process. You do not need to delete your account merely to cancel a subscription.
We will provide renewal, price-change, or other subscription notices when required by applicable law.
Except where required by law or expressly stated in a particular offer, subscription charges are non-refundable and Wyphi does not provide prorated refunds for unused portions of a billing period.
If you believe a charge was unauthorized, duplicated, or otherwise made in error, contact support@wyphi.com.
Wyphi may issue refunds or credits in its discretion. Nothing in these Terms limits consumer rights that cannot legally be waived.
Payments are processed using Stripe.
Payment-card information is entered through Stripe's hosted payment environment. Wyphi receives subscription, customer, transaction, billing-status, and related payment information needed to manage your subscription but does not need to store your full payment-card number.
Stripe processes information under its own applicable terms and privacy practices.
You may use Wyphi only for lawful personal purposes.

Except for user-provided information and third-party materials, Wyphi and its software, meditation content, narration, audio arrangements, session logic, designs, text, branding, trademarks, and other proprietary materials are owned by or licensed to Green House LLC.
Subject to these Terms, Wyphi grants you a limited, revocable, nonexclusive, nontransferable right to use the Service for your personal, noncommercial use.
No ownership rights are transferred to you.
Wyphi relies on third-party services for functions such as hosting, storage, authentication, personalization infrastructure, payments, email, networking, and other operations.
Our Privacy Policy and Consumer Health Data Privacy Policy explain the categories of information involved in those services.
Meditation experiences are individual and can vary.
Wyphi provides meditation, breathing, sound, frequency, and wellness tools but does not promise or guarantee a medical, therapeutic, physiological, psychological, or other specific outcome.
Use Wyphi in an appropriate environment.
Do not use meditation or breathing sessions while driving, operating machinery, swimming, or performing another activity that requires your full attention.
Breathing exercises may cause lightheadedness or discomfort in some people. Stop the exercise and return to normal breathing if you feel dizzy, faint, unusually short of breath, panicked, or unwell.
If you have a medical condition or concerns about whether a breathing practice is appropriate for you, consult a qualified healthcare professional.
Wyphi is not an emergency service. In an emergency, call 911 or your local emergency number. In the United States, you may call or text 988 for the Suicide & Crisis Lifeline.
You may stop using Wyphi at any time.
We may suspend or terminate access when reasonably necessary because of fraud, security threats, nonpayment, unlawful activity, material violation of these Terms, or risk to Wyphi or other users.
Termination does not eliminate payment obligations already properly incurred.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
WYPHI DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, AND WARRANTIES THAT THE SERVICE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR SUITABLE FOR MEDICAL OR THERAPEUTIC PURPOSES.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GREEN HOUSE LLC AND ITS OWNERS, OFFICERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM OR RELATING TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WYPHI'S AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO WYPHI DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW.
To the extent permitted by law, you agree to indemnify and hold Green House LLC harmless from third-party claims arising from your unlawful misuse of the Service, your infringement of another person's rights, or your material violation of these Terms.
This provision does not require you to indemnify Wyphi for Wyphi's own unlawful conduct.
We may modify the Service or these Terms.
If we make a material change to these Terms, we will provide notice as required by law. Changes involving sensitive personal information will also be handled in accordance with applicable privacy law and our privacy notices.
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-laws principles, except to the extent another jurisdiction's non-waivable consumer-protection law applies.
Subject to those non-waivable rights, disputes not resolved informally will be brought in an appropriate state court located in Marion County, Indiana, or the United States District Court for the Southern District of Indiana.
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect.
Our failure to enforce a provision is not a waiver.
You may not assign these Terms without our consent. We may assign them in connection with a merger, financing, reorganization, sale, or transfer of the Wyphi business.
These Terms and the policies incorporated into them constitute the agreement between you and Wyphi concerning the Service.
